Mandatory identification of the approval prior to the importation of products – ANATEL ATO no. 5701 of 2021, which provides:
“
Art. 1° Change the wording of Art. 2 of Act No. 4088, which will come into force with the following wording:
Art. 2 The obligations established in item 5.2.1 of this Procedure will become mandatory after 730 (seven hundred and thirty) days from the publication of this ATO.“
As of 07/30/2022 by ATO No. 5701 of 2021, it will become compulsory to have for imported products prior identified with ANATEL approval before the product enters Brazil, with the exceptions contained in item 5.2.1 of ATO 4088:
“5.2.1. In the case of imported telecommunications products, the identification of the approval must be performed before the product enters the country, except in the following cases:
I – Unfinished products subject to approval whose importation is performed by the Applicant to finish the product in national territory;
II – Products that require the affixing of identification through mint label; and
III – Products for the importer’s own use.
IV – Products intended for medical applications, subject to approval by Anatel, and covered by ANVISA (National Health Surveillance Agency) legislation. (Included by ATONo. 5701 of July 29, 2021)
